10th NASS: Court stops EFCC, DSS from arresting Yari

The Federal High Court in Abuja, on Monday, restrained the Economic and Financial Crimes Commission from arresting or detaining former governor of Zamfara, Abdul’aziz Yari, pending the hearing and determination of a motion on notice.

Also restrained from detaining the ex-governor or taking any such action is the Independent Corrupt Practices and other related offences Commission and the Department of State Services.

Justice Donatus Okorowo made the order following an ex parte application brought before him by Yari through his lawyer, Michael Aondokaa (SAN).

“The respondents are  restrained from detaining the applicant until the return date for the order to show cause,” the judge ruled.

In an ex perte motion,  marked FHC/ANJ/CS/785/23, Yari, who is a senator-elect and an aspirant for the Senate President, alleged a plot to arrest and detain him to prevent him from participating at the Proclamation of the 10th Senate by the President  on June 13.

He alleged that some members of his political party,  the All Progressives Congress, had resorted to using the EFCC, ICPC and the DSS  to harass and threaten to arrest him on trumped-up charges.

“The respondents and their agents have threatened to violate the applicant’s rights as enshrined in the constitution by unlawfully threatening to arrest and detain the applicant,” he alleged.

Yari said he was afraid that if the order was not given, his rights would be breached by the respondents.

After granting the restraining orders, the court adjourned till June 8 for further proceedings.
